A Study on the Effectiveness and System Improvement of the Court-mandated Treatment

Abstract
The number of offenders with mental illness is steadily increasing, and their recidivism rate is higher compared to offenders without mental illness. In addition, the rate of severe crime by mentally ill offenders was five times higher than general criminals. As questions were raised about the effectiveness of the current punishment-centered approach for offenders with mental illness, the treatment order started as an alternative criminal justice system in 2016. While it has been only 5 years, there is lack of empirical studies about the treatment order. The purpose of this study is to evaluate the effectiveness of the treatment order and provide the alternatives for better operation by conducting in-depth interviews with probation officers in charge of treatment orders. As a result of the analysis, in this study, four sub-themes were derived: "Operation suited to the purpose", "Treatment order by participants¡¯ characteristics", "Providing sustainable work environment for practitioners", and "Systematic approach for offenders with mental illness". Based on the research results, policy and practical implications for the effective operation of the treatment order for offenders with mental illness were discussed.
